Healthcare Law
Healthcare law operates in the tension between the duty to heal and the risk of liability. We provide comprehensive support to hospitals, nursing services, care facilities, medical care centers (MVZ), and specialist staff – from formation through contract drafting and licensing matters to liability disputes and proceedings with payers.
Healthcare Law
We know both sides: the medical reality and the legal responsibility.
We advise and represent healthcare providers, in particular hospitals, operators of inpatient care facilities, medical care centers (MVZ), established panel doctors, group practices, and outpatient nursing services, on all legal matters surrounding the conduct of their work.
Our range of services covers cooperation and participation models, support through licensing and approval procedures before the admission and appeals committees, advice in professional-conduct, corporate, and liability law, as well as representation in and out of court vis-à-vis the Associations of Statutory Health Insurance Physicians, health insurance funds, and supervisory authorities. In professional-conduct law, we assist with licensing procedures, questions of medical licensure, and disciplinary disputes.
One focus of our work lies in panel-doctor law, in particular the structuring, transfer, and contribution of panel-doctor seats into an MVZ under Section 95 SGB V – from drafting the practice-purchase and participation agreement, through the strategic planning of the successor appointment, to the legally sound implementation of the waiver in favor of employment at the MVZ and the continuation of the panel-doctor license at the MVZ location. In doing so, we develop tailored solutions that are economically sound and at the same time compatible with the current case law of the Federal Social Court, particularly with regard to needs-based planning, successor-appointment procedures, seat relocations, and preserving the founder status of panel doctors within MVZ structures.
We have particular expertise in the law of statutory health insurance: licensing, fee disputes, economic-efficiency audits, and billing questions are part of our daily work.
In professional-conduct law, we provide support in disciplinary proceedings, disputes with medical associations, and questions concerning medical licensure.
