Employment Law

The healthcare sector is labor-intensive – and therefore especially exposed in employment-law terms. On top of this, many institutions today depend on skilled professionals from abroad. We advise on all employment-law matters and on the employment of foreign skilled workers, and we provide support in negotiations with employee representative bodies and associations.

Employment Law

Wherever people bear responsibility under high pressure, employment-law questions arise that demand specific expertise in healthcare. Employing foreign staff involves considerable bureaucratic hurdles.

We advise employers in healthcare comprehensively: in the process of recruiting management and staff, in the legally sound employment of foreign personnel, in drafting employment contracts and senior-physician contracts, in negotiating works and service agreements, and in dealings with associations. Particular attention here goes to developing strategy and tactics in employment-law disputes. In the event of conflict, we advise and represent our clients out of court and in court – for example, in unfair-dismissal proceedings, formal warnings, and employment-law disputes. We are as familiar with the particularities of the TV-Ärzte or the TVöD/TVL as we are with the typical areas of conflict in the care sector.

The same applies to collective-law questions: works agreements, the co-determination rights of the works or staff council, and cooperation with employee representative bodies are part of everyday employment law in healthcare institutions.

Employment law in healthcare is not a standard case – it is a field of law with its own rules. We know these rules.
